You can only get the max pay out off the policy, the rest you’ll have to sue for in civil court.
There’s nothing hard to believe, insurance has caps regarding payouts and 25k is the max on their insurance.
As stated in general if the insurance agency offers the total amount of the policy in a personal injury claim they are not liable for a large amount if awarded by the courts to you against the defendant
So your option is then to sue the defendant in civil court for the difference but if the defendant does not have assets the judgment will do little good in regard to paying your bills which you are still liable for; does the driver have collectable assets?
You can go to trial and get a judgment requiring the driver to pay all of your damages. His insurance company is only required to cover a judgment up to the amount of their contract with him. The rest is up to the other driver. However, most folks on the road do not have money or assets to pay such a judgment. So, you would get a judgment but no way to enforce it. If the person has wages you could get an order to garnish his wages. Keep in mind, however, that you are talking about spending many thousands of dollars in order to get a judgment that might never be paid. On the other hand, if the other driver has money or assets to pay a judgment, then you might want to go ahead and refuse to settle and demand a trial.
I am guessing that you went to one of those high-volume PI lawyers that advertise on TV. They make their money by settling lots of cases for low amounts. You might want to consider getting a second opinion.
Time to up your uninsured/under insured coverage. Had your policy had this coverage in a sufficient amount, you wouldn’t be paying the 38k.
