I was asleep in my bed at two in the morning back in Feb of 09 and a drunk driver drove through my bedroom. My bed went through the wall into another room and i woke up to a wall and a truck on top of me. I dont remember any of it till i was being taken out of the ambulance at the hospital. I was in St. Fransis Hospital and i ended up with broken/fractured hip&pelvis. Broken finger and wrist. tons of bruising and scaring. Im home and not in school and my dad doesnt think i need a lawyer but i want one so cant i go on my own and get one even though im only 16?

Hit By A Drunk Driver..do I Need A Lawyer?

The night of Feb 2′ 2007 I was sitting at a red light when a car t-boned me. (Hit me directly in the drivers side) On the back quarter panel, exactly where the gas tank is. The lady who hit me was arrested at the scene. My boyfriend was in the car with me. Neither of us were taking by Ambulance to the ER, we went on our own directly after the wreck. Nothing was broken, I have a few scratches on my hand and face, along with back problems, and trouble with ribs. I presume just bruised. The drunken parties insurance company has tried to contact her and she is not getting back to them. They said they are unable to resolve the matter til they speak with their client the one who is not cooperating. (Would it be in my best interest to get a lawyer? Or now do I just have to sit and wait til this lady decides that it’s the right thing to do and talk to her insurance company.

Here’s the long and short of it.
I got rearended. The person drove off and I got their plates. I went to the police station and reported it. That person got pulled in for DUI and Hit and Run.
I called the insured to settle without getting insurance involved (my insurance agent said it was fine). The insured’s lawyer called my agent and said they will pay me X amount of dollars if I sign a waiver.
So I sign the waiver and sent it back Thursday. My agent calls me today and says that the agent said my signature was not legible.
So I said screw it, the deal is off. I’m going to court and I’m going to make sure this lady is prosecuted. Since the lawyer was bluffing and trying to buy time, he changed his mind and said “oh, you know what, it is legible.” I said “too late, you had your chance to settle.”
He says to me “I have your signature right here, if you try to pursue this we will sue.” I said you had your chance, but you stalled and thought lying would work.
